Analysis of Prohibition of Discrimination and Exercise of Employment Rights Published: Alignment of the Legal Framework Relating to Vocational Rehabilitation and Employment of Persons with Disabilities with International Standards

CEDEM published the analysis “Prohibition of Discrimination and Exercise of Employment Rights: Harmonization of the Legal Framework for Vocational Rehabilitation and Employment of Persons with Disabilities with International Standards – Achievements, Problems and Recommendations” is part of the project “Strengthening Professional Capacities to Combat Discrimination with Disability ”, implemented by CEDEM, in cooperation with the Center for Anti-Discrimination“ EKVISTA ”, and supported by the Ministry of Human and Minority Rights.

The analysis is divided into two parts. The first part points to international standards that are relevant for vocational rehabilitation and employment of persons with disabilities. International documents of general character were analyzed, which contain the principles of non-discrimination and equal opportunities, as well as special documents related to the protection of the rights of persons with disabilities (regulations adopted by the United Nations, International Labor Organization, Council of Europe and the European Union). as well as concrete measures aimed at improving the professional rehabilitation and employment of this category of persons, which have been taken at the international level.

The second part of the paper deals with the existing legislative framework related to professional rehabilitation and employment of persons with disabilities in Montenegro. In addition, the emphasis was placed on the employment status of persons with disabilities, both in terms of exercising and protecting individual rights from employment, and in terms of exercising and protecting rights from social security.

Considering that the process of European integration implies harmonization of criteria in all areas of social life, including professional rehabilitation and employment of persons with disabilities, we believe that by introducing international and domestic standards in this area we will contribute to the affirmation of equal opportunities and establishing essential equality. a person with a disability in terms of exercising the right to work.
